1. Acceptance of Terms

By installing or using the MooDuck browser extension and related web services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

MooDuck is a browser extension that assists users in answering test questions by forwarding them to third-party artificial intelligence APIs, including OpenAI, Google AI (Gemini), DeepSeek, and OpenRouter (collectively, "AI Providers"). Responses are generated by those third-party models and are not guaranteed to be accurate, complete, or appropriate for any particular purpose.

3. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement and that all registration information you provide is accurate.

4. User Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree not to:

• Use the Service in violation of any applicable law or regulation.
• Attempt to circumvent rate limits, quotas, or other technical restrictions.
• Reverse-engineer, decompile, or disassemble any part of the Service or extension.
• Resell or redistribute access to the Service without prior written consent.
• Submit questions containing personally identifiable or sensitive information of third parties.

MooDuck is intended as an AI-assisted learning aid. Compliance with your educational institution's academic integrity policies is solely your responsibility. We make no representation that use of the Service is permitted by your institution.

6. Subscriptions and Billing

• The Service offers a free tier and paid plans ("Pro" and "Ultra").
• Paid plans are activated by first topping up your account balance (via our support team) and then purchasing a plan from the account dashboard. Funds are debited automatically from your balance.
• Subscriptions are valid for 30 days from activation and do not auto-renew. After expiry the account reverts to the free tier.
• All purchases are final. Refunds are not provided for unused subscription periods, except where required by applicable law.
• We reserve the right to change pricing with reasonable advance notice.

7. Third-Party AI Services

Your questions are routed to one or more AI Providers. Your use of the Service is also subject to those providers' terms and privacy policies. We are not responsible for the accuracy, legality, safety, or content of AI-generated responses.

8. Data Caching

To improve response speed and reduce costs, MooDuck caches questions and their AI-generated answers on our servers. Cached answers may be returned to other users who ask identical or very similar questions. Do not submit questions that contain personal, sensitive, or confidential information.

9. Intellectual Property

The MooDuck name, logo, extension, and all related software are the intellectual property of MooDuck. You are granted a limited, non-exclusive, non-transferable, revocable license to use the browser extension for personal, non-commercial purposes in accordance with these Terms.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT AI-GENERATED ANSWERS WILL BE ACCURATE OR FIT FOR ANY PURPOSE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOODUCK AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO ACADEMIC PENALTIES, LOSS OF DATA, OR LOSS OF REVENUE.

12. Changes to These Terms

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify users of material changes (e.g., via the website or Telegram channel).

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved in the competent courts of the applicable jurisdiction, or through binding arbitration as agreed by the parties.
